6 Guest’s right of withdrawal

The guest is entitled to withdraw from the contract concluded with the host free of charge up to four weeks before the agreed arrival date. To meet this deadline, the timely receipt of the notice of withdrawal (in writing or by email to buchung@ferienwohnung-kolbermoor.de) by the host is sufficient.

After the withdrawal period pursuant to the above paragraph has expired, any withdrawal by the guest from the contract concluded with the host requires the consent of the host, unless expressly agreed otherwise. If the host does not consent to the guest's withdrawal, the guest must pay the agreed price even if they do not use the contractual services. This does not apply if, after weighing the interests of both parties, it is unreasonable for the guest to adhere to the contract or if they are entitled to another statutory or contractual right of withdrawal. If the guest is required to pay the agreed price and does not use the apartment, the host must offset any income from any other rental of the apartment as well as any saved expenses against the price to be paid by the guest. If the apartment is not rented to another party, the host's saved expenses will be offset at 10% of the agreed price, i.e. in this case the guest must pay 90% of the agreed price. The guest is free to provide evidence that the aforementioned claim did not arise or did not arise to the required amount.

Any deposit or security deposit paid by the guest in accordance with Section 5 will be refunded to the guest within two weeks of receipt of the cancellation notice. In the case of cancellation less than four weeks before the agreed arrival date, this only applies to the extent that the deposit or security deposit exceeds the guest's payment obligation.

After the guest has declared his/her cancellation, the hosts are entitled to rent the booked apartment to someone else.
